Johnson Victim Refuses to Turn Over Medical Records

Judge calls the refusal "very concerning."

Even after being ordered to do so by the court, the victim in the Curt Johnson child sex assault case, and her mother, are refusing to turn over medical records.

The information was revealed during Johnson's Oct. 21 status hearing before Judge Eugene Gasiorkiewicz, according to a story in The Journal Times.

Calling the refusal "very concerning,"Β  Gasiorkiewicz was going to look at the records before passing along any material he deemed appropriate to both the defense and the prosecution. He ordered lawyers - defense, prosecution and the girl's attorney - to have written explanations to him by 5 pm Tues., Oct. 25.

Johnson's attorneys Mark Richards and Michael Hart had requested the girl's records to possibly discover a condition that would have led her to misperceive events. But Racine Count District Attorney Michael Nieskes and Assistant District Attorney Robert Repischak said Johnson's lawyers haven't proved their point and that they have no right to the records.

Kathleen Quinn, the girl's lawyer, said because of the right to confidentiality, the girl, now 15, and her mother both refuse to sign permission. Prosecutors asked the judge to issue a subpoena for the records.

Attorneys for the defense, the prosecution and the victim have to file motions, also by 5 pm on Tues., Oct. 25, with their legal opinions on how Gasiorkiewicz should proceed. He could appoint a guardian ad litem, which is a special lawyer for children to represent the best interests of the child in court.

Johnson was with first degree repeated sexual assault of a same child. The victim told police that Johnson touched her inappropriately on multiple occasions over a period of several years. He also allegedly asked the victim to have sex with him, but she refused. Johnson entered a plea of .

At a , Johnson was granted permission by Gasiorkiewicz to travel to Arizona for treatment, for business and . But at a , the same judge ruled that Johnson's alleged confession, possibly to this same therapist, would be allowed. It was at that same hearing that Gasiokiewicz made his decision about the victim's medical and mental health records.

Johnson is one of the heirs to the SC Johnson family fortune. He stepped down as head of Sturtevant-based Diversey, Inc. in February citing "personal reasons." His sister, Helen Johnson-Leopold, took over as head of that company.
