When they arrived, a woman told them she was staying with Applegate at the hotel. After he made suggestive remarks to the victim that she told police made her uncomfortable, the woman went outside. The defendant reportedly told the woman to come back inside or leave so she went back into the room.

When she lay down on the couch to go to sleep, the report reads, Applegate attacked her. The defendant then allegedly tried to assault her again, the woman attempted to leave, and that's when Applegate picked her up and threw her out of the room.
