Judge Denies Removing Bittner Monitoring

Gordon Bittner, Jr. will remain on electronic monitoring but he will be allowed to assist his father with personal and professional tasks.

Bittner appeared in court Friday morning asking for his GPS bracelet to be removed so he can move around town more freely to help his father at home and at work. He appeared in person with his defense attorney, Steven Kohn.

Gordon Bittner, Sr. was severely injured when an SUV struck the motorcycle Sr. was riding. Since his release from the hospital, the court modified Jr.'s bond to allow him to take his dad to medical appointments.

"We believe young Mr. Bittner will not offend again and that he has gotten the message," Kohn told the court.

Sr. attended court with his son, wearing a neck brace and using crutches. He is a local real estate agent.

Assistant District Attorney Noah Wishau objected with removing the GPS because Jr. is accused of burglary, and he is not comfortable with the defendant having access to homes.

"I also need to note that the defendant was out on bond without monitoring when he committed this burglary," he told the court.

Kohn said that Jr. has moved back home so his father can provide some supervision and that Jr. would not show houses but do more of the day-to-day running around.

Racine County Circuit Court Judge Timothy Boyle agreed to modify Jr.'s bond to allow him more freedom but would not authorize removal of the GPS bracelet.

"It is too premature to fully release Mr. Bittner, and his bond already allows him to go to work," Boyle said. "If his father is hiring him, then the bond modification covers this."

The judge told Jr. he will be required to report the times, dates and locations he will be out and about so the information can be verified.
