Supreme Court Hears Johnson Child Sex Assault Case

The child sex assault case against the billionaire SC Johnson heir can't move forward until the justices issue a decision on an appeal in the matter.

Wisconsin Supreme Court justices heard arguments this week on the ongoing question about whether the alleged victim in the Curt Johnson child sex asault case has to release her medical records and if she will testify in the case. Attorneys on both sides of the Johnson case laid out their cases before the high court on Monday. The Racine County case is on hold, pending the justices' decision on the appeal. Johnson was charged in March 2011 with repeated sexual assault of the same child after a therapist in Arizona reported that Johnson said in therapy sessions that he inappropriately touched his stepdaughter. As issue is whether the victim has to release her medical records, and if she'll be allowed to testify if she refuses to do so. …

Case in Review: Curt Johnson Charged with Child Sex Assault

The case against the billionaire and heir to the Sam Johnson fortune and business legacy is headed to the Wisconsin Supreme Court.

What: Curt Johnson is accused of inappropriately touching a girl, exposing himself and asking her to have sex with him. The girl reportedly told investigators she did not remember how old she was when the activity started. Shortly before the charges were filed Johnson took a leave of absence from Diversey, Inc., the company he ran.  Charges: Johnson was charged with repeated sexual assault of a child in March. He posted $500,000 cash to be released from jail. If convicted, Johnson faces up to 40 years imprisonment, which includes time in prison or on extended supervision. Supreme Court Will Review Curt Johnson Child Sex Assault Case

After waiting it out for a few months, it appears as though the state's highest court will review a portion of the Curt Johnson child sex assault case.

The state's highest court has decided to review a portion of the child sex assault case pending against Curt Johnson. A request for review was first filed by the state Attorney General's office with the Wisconsin Supreme Court last spring. At issue is an appellate court ruling, which stated that as long as the alleged victim withholds her medical records, she does not have to testify. The AG's office filed the appeal on May 17, one day short of the deadline. The Court of Appeals Second District panel upheld part of the original ruling by Racine County Circuit Court Judge Eugene Gasiorkiewicz, agreeing that the victim has the right to keep her medical records private. No Supreme Court Decision in Johnson Child Sex Assault Case

The criminal case against billionaire Curt Johnson can't proceed until the state Supreme Court makes a decision on whether or not to hear arguments about the victim and her medical records.

Billionaire Curt Johnson's trial on child sex assault charges does not yet have a start date. The circuit court is waiting for the state Supreme Court to decided whether or not the justices will hear arguments about the alleged victim to uphold her claim to privacy and not turn over her medical records. This is the third status conference to see if Johnson's case gets on the high court's calendar. Judge Eugene Gasiorkiewicz said Friday there is Sept. 14 calendar meeting for the justices but calls to the clerk in Madison did not reveal if Johnson's case is being considered. Curt Johnson Child Sex Assault Case Still on Hold

The state Supreme Court has not determined if it will take up whether or not the alleged victim witness can continue withholding her medical records but still testify.

The child sex assault case against Curt Johnson remains on hold. On Friday, attorneys for the state and the defense met in Judge Eugene Gasiokiewicz's courtroom for a status conference. Attorney Richard Hall, one of Johnson's defense attorneys, appeared via telephone. Assistant District Attorney Robert Repischak and defense attorney Michael Hart appeared in person. The parties, including the court, were trying to determine if the state Supreme Court has decided to hear a petition for review filed by the Attorney General on behalf of the state. UPDATE: No Decision From Supreme Court On Curt Johnson Child Sex Assault Case

Parties are still waiting to hear whether the Supreme Court will accept the case on appeal. The two sides have asked for a ruling on issues surrounding the victim's medical records and testimony.

With the child sex assault case against Racine billionaire Curt Johnson on hold, pending a decision by the state Supreme Court, the parties talked Friday to get a general status update of the case. During the conference call between Racine County Circuit Court Judge Eugene Gasiorkiewicz and the attorneys from both sides, Gasiorkiewicz said the Supreme Court judges have not made a decision on the matter and scheduled another status conference for July 20. Proceedings in the case should wait until after the State Supreme Court decides whether or not it will hear an appeal the prosecution has requested, Judge Eugene Gasiorkiewicz said during a status hearing Friday.

The child sex assault case against Racine billionaire Curt Johnson will stay on hold until the state Supreme Court makes a decision about hearing arguments about an appeals court ruling. The state Attorney General, on behalf of the proscecution, filed a petition for review with the Supreme Court after the Court of Appeals agreed with Racine County Circuit Court Judge Eugene Gasiorkiewicz's ruling last fall that the alleged victim in the case can uphold her claim to privacy and not turn over her medical records. The appellate court in that same decision also said, though, that the girl will not be allowed to testify as a sort of sanction for not releasing her records. Attorney General Asks Supreme Court to Review Appellate Decision in Curt Johnson Case

As expected, the state Attorney General's office has asked the state Supreme Court to review the decision by the Court of Appeals in the Curt Johnson child sex assault case.

Whether or not the victim at the center of the Curt Johnson child sex assault case will testify could rest in the hands of the state Supreme Court. The Attorney General's office today asked the state's high court to review a decision from the Court of Appeals Second District that said as long as the victim withholds her medical records, she does not have to testify. According to a story in The Journal Times, the AG's office had until tomorrow to file the request. Racine County prosecutors wanted the lower court to force the records release so Circuit Court Judge Eugene Gasiorkiewicz can conduct an in camera review. Several readers and observers of the Curt Johnson child sex assault case have asked Patch if the judge should have disclosed that his campaign received a donation from the Johnson family. We tried to find out.

Curt Johnson Child Sex Assault Trial Delayed

Issues related to ongoing appeals, witnesses and other logistics have kept the child sex assault trial of Curt Johnson from going forward as scheduled.

The child sex assault trial of Curt Johnson is off this week, after a judge granted the state’s request for a delay, and the court of appeals ordered a halt to proceedings.  Johnson stands accused of repeated sexual assault of the same child, for allegedly abusing a girl over a period of several years. The trial was due to begin Monday morning, but Judge Eugene Gasiorkiewicz granted the District Attorney's motion for a continuance.  Later in the day, the court learned of a second reason to hold off: The Court of Appeals granted the prosecution's request for a stay of the local proceedings.  Johnson was charged on March 24, 2011 with first degree sexual assault of the same child.
