When the younger boy's mom realized her son was no longer at the cookout, she went back to her home and discovered both boys in the family pool. The older boy was seen hugging the younger boy from behind.

When the mother got the boys out of the pool, the 6-year-old told his mother that, among other things, the 12-year-old had kissed him on the mouth with his tongue, After officers arrived, the victim repeated what he said he told his mom and that led officers to surmise the boy had been raped.
